FTA-2007-0023 – Advisory Opinions
Amended Advisory Opinion and Cease and Desist Order 08-23 for TARC: On October 31, 2008, the Transit Authority of River City (TARC), submitted to the FTA a "Compliance Report," which provided information regarding the University of Louisville (UL) shuttle service performed by TARC. Specifically, the Compliance Report demonstrated that the UL shuttle, commonly known as Route 94, shares bus stops with other routes in TARC's system. FTA has AMENDED their previous Advisory Opinion and Cease and Desist Order (08-23) and advised Miller Transportation that its request for a cease and desist order is DENIED because TARC's Route 94 does not constitute charter service since the service is not exclusive to UL students and faculty. Route 94 connects to other routes in TARC service area, and TARC controls the route and schedule of Route 94.
Potomac Valley Transit Authority Opinion: FTA granted a hardship waiver to provide
charter service to a group of individuals to a location in Petersburg, West Virginia because the registered charter provider had a deadhead time that exceeded the total trip time from initial pick-up to final drop-off, including wait time.
Miller Transportation Advisory Opinion Request- Day on the Town: In consideration of the community service provided by TARC's Day on the Town service, Miller Transportation wishes to withdrawal the Cease and Desist portion of their earlier Request for Advisory Opinion and Cease and Desist Order (FTA2007-0023-0080.1). However, they are still requesting the FTA's guidance related to such programs (through the Request for Advisory Opinion) and do not want to deter the potential use of the Day on the Town Service by groups for whom the use of a private operator may not be an option.
Sacramento Regional Transit District Opinion Request: Sacramento Regional Transit District ("RT") has received funds from a local Transportation Management Association (TMA) to establish and operate regular bus service between RT's Roseville Road light rail station and a local business park. They are requesting an opinion of whether or not this counts as charter service.
FTA-2007-0022 – Petitions to the Administrator
Northwest Alabama Council of Local Governments Petition- The Northwest Alabama Council of Local Governments, authorized 5307/S311 provider for Northwest Alabama, was requested by the Shoals National Championship Committee to provide shuttle bus service for a Division II National Championship Football game in Florence, Alabama and is seeking an exemption.
King County Department of Transportation, Metro Transit Division – A petition for exception to charter service regulation for 2008 Marines Service.
LaKing Trucking, Inc: A petition for exception to charter service regulation for 2008 Marines Service and clarification of nature and purpose of the original petition as well as a renewed request for expedited review.
Washington Metropolitan Transit Authority (WMATA): - On October 6, 2008, WMATA submitted a request for an exception under 49 C.F.R.§604.11(a)(3) petition to the Administrator for a Unique and Time Sensitive Event. WMATA's current petition requests an exception to provide bus transportation for the United States Paralympic Team to travel to the White House.
Regional Transportation Commission (RTC) of Southern Nevada Petition Withdrawal
The RTC had previously provided service to the Las Vegas Motor Speedway's NASCAR races, but current charter regulations prohibit the RTC from providing that service as they have in previous years, thus they withdrew their petition.
Northwest Alabama Council of Local Governments Petition Withdrawal
Since they are the designated public transit provider for this area and received funds as a sub-recipient from the FTA, they were required to file for this exemption, but after filing the exemption request they had private sector transit providers that were willing to provide the service.
